Centre for Legal Assistance to Pollution Victims, China
The centre is approved by China's University of Political Science and Law, and registered with the Chinese Judicial Ministry.
CLAPV has established a growing network of lawyers across China who are willing to bring cases under environmental laws. An ADMCF investing partner, Olivier Cheah and Partners Limited, is currently supporting fellowships for Chinese lawyers to spend time in the United States with a world-wide environmental law association, E-Law. E-Law connects lawyers from 30 different countries, providing training and access to scientists who can then aid the fellow in their environmental cases at home.
Status
Four China fellowships were provided in 2007. The fellows worked with ELAW staff lawyers and scientists on cases being prepared to appeal to China's Supreme Court. One case concerns allegations that almost a dozen residents of a housing complex died from cancer due to high levels of benzene exposure. In another case, residents are suing factories for dumping toxic chemicals into a river, harming fish and crops. These cases could take some time before reaching a final judgment. ELAW lawyers from Slovakia, Spain, and the Ukraine are helping in this effort.
A further funding commitment by Olivier Cheah has been made for an additional three fellowships in 2008.
